These Terms of Service ("Terms") govern your access to and use of Whisperly's software, website, applications, and related services (collectively, the "Service"). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of the Service

Whisperly is an interview assistant that listens to your interview audio and provides real-time suggestions on an overlay visible only to you. The Service is provided for personal, lawful use and is intended to help you prepare for and perform during interviews.

3. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You are responsible for ensuring that your use of the Service complies with any agreements, policies, or rules that apply to you, including those of any interview, employer, or examination you participate in.

Paid plans are billed on a recurring basis until cancelled. Fees are non-refundable except where required by law. We may change pricing with reasonable notice, and continued use after a price change constitutes acceptance of the new pricing.

The Service, including all software, text, and design, is owned by Whisperly and its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

9. Disclaimers

To the maximum extent permitted by law, Whisperly will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or opportunity arising from your use of the Service.

11. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or if we discontinue the Service. Upon termination, your right to use the Service will immediately cease.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the date below and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
